Mutual & Federal will require a completed motor claim form in cases where a third party is involved, or where passengers are injured.
Mutual & Federal will liase with the Third Party or his/her insurer on your behalf.
Immediately send any correspondence you may receive from them to your local Mutual & Federal branch.
Do not prejudice Mutual & Federal by signing any admission of liability or verbally admitting liability.
Even though there is no obligation on Mutual & Federal to recover your excess from the 'guilty' party, we do, as a service to you, actively endeavour to recover your excess.
Your help in providing Mutual & Federal with all the relevant information pertaining to the other party and any independent witnesses will expedite the process of initiating and attempting the recovery of your excess.
Key details required are:
- A clear detailed description and sketch of the accident.
- Name, address, telephone numbers(home, business & cellular) and ID number of the other driver.
- Name, address, telephone numbers and ID number of the owner of the other vehicle (if different to driver).
- Other vehicle's registration number.
- Name, address, telephone numbers of independent witnesses.
- Details of the police officers who attended the scene of the accident and details of the Police station to which the accident was reported and their case reference number if available.
Useful Tips
- Ask to see the other party's ID document to ensure that you get the correct ID number.
- Do not prejudice Mutual & Federal by entering into an agreement with the other party regarding the claim.
If Mutual & Federal is not successful in recovering your excess or where Mutual & Federal elects not to pursue a recovery, you may proceed against the third party in an appropriate court of law such as the
Small Claims Court. Mutual & Federal will assist you by confirming the cost of repairs and provide all details on record relevant to the recovery of the excess by you. We believe that justice can be done swiftly and cheaply in the Small Claims Court should the amount that you wish to claim fall within this court's jurisdiction. The services of the Magistrate's Court could also be utilised for larger claims (such as where you have an uninsured loss, which you also wish to recover).
If anyone is injured in an accident it is most important that you report this to your nearest Road Accident Fund office. Failure to do so could result in your being liable for any payments to the injured person.
